    Online Search Options

    Two primary online systems are available for Wasatch County court records:

    • MyCase (My Court Case) — This free portal is available to parties named in a case. To register, you'll need a valid email address, your court case number, and a government-issued photo ID. Once your account is verified, you receive instructions by email and can view case history, hearing schedules, and related documents. Direct questions about the system to mycase@utcourts.gov.
    • Xchange Public Case Search — Xchange is Utah's subscription-based case repository covering both district and justice court records statewide, including Wasatch County. Subscribers pay a monthly fee of $40.00, which includes 500 searches, with additional searches billed at $0.35 each and document downloads at $1.00 per item. If you prefer not to subscribe, public terminals at the 4th District Court courthouse in Heber City give you free in-person access to Xchange.

    Responses to formal record requests may take up to 10 business days. Keep in mind that records already available through Xchange will not be sent by fax or email — those must be accessed through the online system or a public terminal.

    Historical Records

    Court records older than 50 years from the 4th District Court are held by the Utah Division of Archives and Records Service. This archive also maintains older probate, land, and court records from Wasatch County that predate the digital case management era.

    Are Court Records Public in Wasatch County?

    Under Utah Code of Judicial Administration Rule 4-202.02, court records carry a presumption of public access. Any person may inspect or copy public court records, and courts are obligated to make those records available in a reasonable manner under Rule 4-202.03.

    That said, Utah law recognizes several categories of records classified as non-public. These include:

    • Juvenile court records (delinquency, child welfare, termination of parental rights)

    • Records relating to consent for abortion by a minor

    A significant change took effect on April 1, 2012, when amendments to Rule 4-202.02 reclassified certain civil action records as private. Case types affected include divorce, separate maintenance, grandparent visitation, temporary separation, civil stalking, guardianship, conservatorship, cohabitant abuse, custody and support, paternity, and related family law matters. While detailed filings in these cases are now private, the case history showing minute entries from public hearings, final judgments, orders, decrees, and letters of appointment generally remain accessible unless sealed by judicial order.

    Accessing non-public records or sealed documents requires a court order or a showing of eligibility under Utah law.

    Wasatch County Criminal Court Records

    Criminal cases in Wasatch County are split between the 4th District Court and the Wasatch County Justice Court depending on the severity of the offense. All felony charges and Class A misdemeanors are filed in the District Court. Class B and Class C misdemeanors, infractions, and traffic violations go to the Justice Court.

    Criminal court records available through Xchange or public terminals include party names and addresses, case numbers, assigned judges, attorneys of record, documents filed, hearing dates, and case outcomes. These records are distinct from broader criminal history records, which are compiled and maintained by law enforcement agencies rather than the courts.

    For criminal history information — including arrests, warrants, probation status, and incarceration records — the Utah Department of Public Safety Bureau of Criminal Identification (BCI) is the authoritative state source. The BCI maintains the Utah Criminal History (UCH) database and processes background check requests for individuals, employers, and agencies. Depending on the type of request, submissions to the BCI may require fingerprinting and a processing fee.

    Wasatch County Civil Court Records

    The 4th District Court handles general civil litigation in Wasatch County — contract disputes, personal injury claims, landlord-tenant matters, and other civil proceedings above the small claims threshold. The Wasatch County Justice Court handles small claims cases involving defendants who reside within the county or where the claim arose within county boundaries.

    Wasatch County Family Court Records

    Family law matters in Wasatch County — divorce, legal separation, child custody, child support, paternity, domestic violence, and cohabitant abuse protective orders — are heard by the 4th District Court. As noted above, the 2012 amendment to Rule 4-202.02 reclassified many family case filings as private records, which limits broader public access to these proceedings.

    Divorce Records

    Divorce case records are classified as private and may only be accessed by the parties themselves, their immediate family members, and their legal counsel. Divorce certificates — as distinct from court case files — are issued by the Wasatch County Health Department and are also available from the Utah Office of Vital Records and Statistics.     Marriage Records

    Marriage licenses are issued by the Wasatch County Clerk-Auditor's Office. Marriage records become fully public 75 years after creation. Before that threshold, access is limited to the parties named in the record, their immediate relatives, legal guardians, and authorized legal representatives. Records from 1978 to 2010 can be requested online through the Utah vital records portal. Records outside that range are available through the Clerk-Auditor's Office in Heber City.

    Juvenile Court Matters

    Cases involving minors — including juvenile delinquency, child welfare proceedings, and termination of parental rights — are handled exclusively by the 4th District Juvenile Court. These records are not publicly accessible and do not appear in Xchange searches.

    Wasatch County Probate Court Records

    Wasatch County has no separate probate court. All probate and estate matters are managed by the 4th District Court, which hears cases involving wills and estate administration, name changes, trust proceedings, guardianship and conservatorship appointments, and related legal matters.

    Probate records that fall within the public record classification can be searched through MyCase if you are a party to the case, or through Xchange for general public searches.     Older probate records — the county's probate records extend back to 1897 — can be found through the Utah Division of Archives and Records Service, which holds 4th District Court records more than 50 years old.     To formally request a copy of any probate record, submit a completed Request for Court Record form to the District Court.
