Two primary online systems serve the public for Wasatch County court records:

Court records older than 50 years from the 4th District Court are held by the Utah Division of Archives and Records Service. This archive also maintains older probate, land, and court records from Wasatch County that predate the digital case management era.

Are Court Records Public in Wasatch County?

Under Utah Code of Judicial Administration Rule 4-202.02, court records carry a presumption of public access. Any person may inspect or copy public court records, and the courts are obligated to make those records available in a reasonable manner under Rule 4-202.03.

However, Utah law recognizes several categories of records that are classified as non-public. These include:

Case types affected include divorce, separate maintenance, grandparent visitation, temporary separation, civil stalking, guardianship, conservatorship, cohabitant abuse, custody and support, paternity, and related family law matters. While detailed filings in these cases are now private, the case history showing minute entries from public hearings, final judgments, orders, decrees, and letters of appointment generally remain accessible unless sealed by judicial order.

Requests to access non-public records or to obtain sealed documents require a court order or a showing of eligibility under Utah law.

Wasatch County Criminal Court Records

Criminal cases in Wasatch County are divided between the 4th District Court and the Wasatch County Justice Court depending on the severity of the offense. All felony charges and Class A misdemeanors are filed in the District Court, which holds full general jurisdiction. Class B and Class C misdemeanors, infractions, and traffic violations are handled by the Justice Court.

Criminal court records available through Xchange or public terminals include party names and addresses, case numbers, assigned judges, attorneys of record, documents filed, hearing dates, and case outcomes. These records are distinct from broader criminal history records, which are compiled and maintained by law enforcement agencies rather than the courts.

For criminal history information — including arrests, warrants, probation status, and incarceration records — the Utah Department of Public Safety Bureau of Criminal Identification (BCI) is the authoritative state source. The BCI maintains the Utah Criminal History (UCH) database and processes background check requests for individuals, employers, and agencies. Criminal history requests submitted to the BCI may require fingerprinting and a processing fee depending on the type of request.

Wasatch County Civil Court Records

The 4th District Court handles general civil litigation in Wasatch County, including contract disputes, personal injury claims, landlord-tenant matters, and other civil proceedings above the small claims threshold. Divorce Records

Divorce case records are classified as private and may only be accessed by the parties themselves, their immediate family members, and their legal counsel. Divorce certificates — as distinct from court case files — are issued by the Wasatch County Health Department and are also available from the Utah Office of Vital Records and Statistics. Marriage Records

Marriage licenses are issued by the Wasatch County Clerk-Auditor’s Office. Marriage records become fully public 75 years after creation. Before that threshold, access is limited to the parties named in the record, their immediate relatives, legal guardians, and authorized legal representatives. Juvenile Court Matters

Cases involving minors — including juvenile delinquency, child welfare proceedings, and termination of parental rights — are handled exclusively by the 4th District Juvenile Court. These records are not publicly accessible and do not appear in Xchange searches.

Wasatch County Probate Court Records

Wasatch County has no separate probate court. All probate and estate matters are managed by the 4th District Court, which hears cases involving wills and estate administration, name changes, trust proceedings, guardianship and conservatorship appointments, and related legal matters.

Older probate records — the county’s probate records extend back to 1897 — can be found through the Utah Division of Archives and Records Service, which holds 4th District Court records more than 50 years old.
