In-Person Search

Public access terminals are available at the Tooele County courthouse, allowing free in-person searching of case information. Staff at the clerk’s office can also assist with locating records.

Are Court Records Public in Tooele County?

The default position under Utah law is that court records are public. Rule of Judicial Administration 4-202.02 establishes that court records are public unless otherwise classified, and any person may request access to public records without stating a reason. However, the same rule creates four distinct categories under which records may be withheld from general public access:

  • Public records — Open to anyone without restriction, including most civil and criminal case filings, judgments, and hearing minutes.
  • Private records — Accessible only to the parties involved or authorized persons. Examples include petitions for divorce, requests for protective orders, medical records submitted in court, adult guardianship petitions, and motions for fee waivers.
  • Protected records — Restricted due to policy or legal privilege, including confidential business information, court security plans, and attorney-client privileged materials.
  • Sealed records — Completely withheld from public access. Sealed categories include adoption cases and expunged criminal records.

Juvenile Court records — including delinquency, child welfare, and termination of parental rights proceedings — are not available to the public and do not appear in XChange. To access sealed, private, or protected records, a party must either obtain a court order or subpoena the record through appropriate legal channels.

The Utah Code of Judicial Administration 4-202.04 governs the procedures for requesting access, including the right to challenge a denial. Requests for public court records must generally be submitted in writing to the clerk of the court where the case was filed.

Tooele County Criminal Court Records

The Tooele County 3rd District Court handles all felony cases and Class A misdemeanor criminal matters. Class B and C misdemeanors, infractions, traffic citations, and ordinance violations are handled by the county’s justice courts. Statewide Criminal History — Utah BCI

The Utah Bureau of Criminal Identification (BCI) maintains statewide criminal history records and processes background check requests. Under Utah law, full criminal history records are restricted — only the record subject, authorized third parties, and qualifying government entities may obtain them. As of July 1, 2025, the BCI fee for a Right of Access (personal criminal record request) is $20.00, payable by credit/debit card, check, money order, or cash for in-person requests. A completed application form along with valid photo identification — such as a driver’s license, passport, or state ID — is required.

Requests on behalf of a third party require a completed third-party release form attached to the application. BCI is open Monday through Friday, 8:00 a.m. to 5:00 p.m.

Tooele County Civil Court Records

Civil cases in Tooele County are split between the 3rd District Court, which handles all major civil litigation and disputes above small claims thresholds, and the justice courts, which have jurisdiction over small claims cases. The Clerk of Court at the 3rd District Court maintains records of civil proceedings including complaints, answers, motions, discovery filings, judgments, and appeals.

To obtain copies of civil court records, requesters should submit a completed Request for Court Record form to the clerk at the Gordon R. Hall Courthouse. The form can be delivered in person or mailed. Staff will contact the requester if payment arrangements are needed for staff research time beyond the first 15 minutes.

Online Access

Summary civil case information is searchable through XChange. However, it is important to note that following a 2012 amendment to Rule 4-202.02, several civil case categories — including divorce, guardianship, conservatorship, cohabitant abuse, custody and support, and paternity actions — have certain document types designated as private. Public elements that remain available include the case history with hearing minutes, final judgments, orders, decrees, and letters of appointment, unless further restricted by judicial order.

Small Claims

Small claims cases in Tooele County are heard by the justice courts. Litigants in small claims matters can obtain self-help information and forms through the Utah Courts self-help resources and at the justice court clerk’s office.

Tooele County Family Court Records

Family law matters in Tooele County — including divorce, legal separation, child custody, child support, paternity, domestic violence protective orders, and adoption — are heard before the Tooele County 3rd District Court. Divorce Records

Divorce cases are filed with and adjudicated by the 3rd District Court. The final decree and related orders remain part of the public court record unless sealed by judicial order. Adoption Records

Adoption proceedings are sealed records under Utah law and will not appear in XChange or be available through general public records requests. Access to adoption records requires a court order or falls under specific statutory procedures outlined under Utah’s adoption records statutes.

Marriage Records

The Tooele County Clerk’s Office is the official repository for marriage records. Certified marriage certificates are restricted to the named parties, their spouses, parents, siblings, grandparents, legal representatives, or individuals with a court order. Uncertified copies may be requested by any person.

Vital records including birth and death certificates are maintained by the Tooele County Health Department, not the courts. Birth records from 1931 to present and death records from 2006 forward are on file. These records are restricted to named individuals and their immediate family members.

Tooele County Probate Court Records

Probate matters in Tooele County — including the administration of estates, wills, name changes, conservatorships, and adult guardianships — are handled by the Tooele County 3rd District Court. The Clerk of Court maintains active and recent probate records, while older historical records are held by the Utah Division of Archives and Records Service.

How to Search Probate Records

Current probate case information, including estate proceedings, guardianships, and conservatorships, can be searched through XChange, subject to applicable fees. Note that adult guardianship records are classified as private under Rule 4-202.02, meaning they are not publicly accessible without authorization.

For in-person searches, members of the public can visit the Gordon R. Hall Courthouse and use the public access terminal or request assistance from the clerk’s office. Historical probate records from as far back as 1859 are archived with the Utah Division of Archives, which researchers may visit to review records in their custody.
