Accessing court records in Utah can be done through several official channels. Clerk offices at the district and justice court levels allow in-person review and copying, while public access terminals provide basic lookup capability at the courthouse. Online tools maintained by the Utah Courts allow remote searches of district and justice court cases. UtahCourts.us may help users locate publicly available court case information across the state and identify the appropriate court for a particular record type.

How to Look Up a Court Case in Summit County?

Summit County’s judicial structure consists of three courts: the 3rd District Court (Summit County Division), the 3rd District Juvenile Court, and the Summit County Justice Court. Each court handles different types of cases and maintains its own records.

Online Search — Xchange:
The primary online tool for searching Summit County court records is Xchange, Utah Courts’ official public case search repository. Xchange contains district court and justice court records, with district court electronic documents available for cases filed since July 1, 2010. Three access options are available:

Monthly subscribers receive 500 searches per billing cycle before per-search charges begin. Government agencies within Utah that are required by law to obtain court records may request a fee waiver by emailing a request on agency letterhead to xchange@utcourts.gov.

MyCourtCase:
Parties who have an active case may use MyCourtCase to view case history, upcoming appearances, and filed documents specific to their own matters. This tool is distinct from Xchange and does not require a subscription fee for parties to their own cases.

The Justice Court also publishes a court calendar on the Summit County website showing upcoming hearing dates for traffic, small claims, and other cases.

Are Court Records Public in Summit County?

Utah’s Government Records Access and Management Act (GRAMA), codified at Utah Code Chapter 63G-2, establishes the framework governing access to government records, including court records. Under Utah Code § 63G-2-201, members of the public have a general right to inspect or obtain copies of public records from the government entities that maintain them.

However, GRAMA also establishes categories of records that are not subject to public disclosure. Records may be classified as private, controlled, or protected under Sections 63G-2-302 through 63G-2-305, which cover a range of sensitive personal and governmental information. In Summit County courts, records that may be withheld or restricted include:

  • Juvenile court records — Generally sealed and not available to the public
  • Records sealed by court order — A judge may seal specific case records for cause
  • Records classified as private under §§ 63G-2-302 to 305 — Including certain personal information, medical data, and other sensitive categories
  • Records exempt by state statute — Various statutes impose specific confidentiality requirements on certain case types

Parties denied access to a record may appeal the denial through GRAMA’s appeal process. Requesters should be prepared to provide identifying information about the case — such as a case number, party name, and approximate filing date — when submitting records requests.

Summit County Criminal Court Records

Felony criminal cases in Summit County are heard by the 3rd District Court. Misdemeanors, class B and C charges, infractions, and traffic violations are handled by the Summit County Justice Court. The 3rd District Juvenile Court handles delinquency matters involving minors; those records are generally not public.

District court criminal records are maintained by the court clerk at 6300 Justice Center Road, Suite A, Park City. In-person requests should be made during regular business hours at (435) 615-4300. Justice Court criminal records are similarly maintained at the same complex and may be requested by contacting the Justice Court at (435) 615-3800 or emailing jcsummit@utcourts.gov.

For online searches, Xchange provides access to district court and justice court criminal case records. Users can search by party name or case number after establishing a paid account.

The Sheriff’s Office Criminal Investigations Division handles requests related to criminal investigations. For jail and inmate information, the Sheriff’s Office maintains a jail division reachable through the main number.

Summit County Civil Court Records

Civil cases in Summit County are divided between the 3rd District Court, which handles general civil litigation, and the Summit County Justice Court, which handles small claims matters.

The 3rd District Court has jurisdiction over civil cases involving contract disputes, personal injury claims, property matters, and other general civil litigation. Civil records are maintained by the district court clerk at 6300 Justice Center Road, Suite A, Park City, UT 84098.

Small Claims Court is a division of the Summit County Justice Court. Small claims matters involving disputes over amounts within Utah’s small claims limit are heard by Judge Janet Elledge at the Justice Court, also located at 6300 Justice Center Road. To search civil records online, Xchange provides access to district and justice court civil case filings. Users can search by party name or case number and retrieve docket entries, case history, and electronic documents filed since July 1, 2010. The Xchange fee structure described above applies to all civil case searches.

For in-person civil record requests, visit the district court clerk’s office during regular business hours (Monday–Friday, 8:00 a.m. – 5:00 p.m.). Fees may apply for copies and certified documents; the court clerk can provide the current fee schedule at the time of request.

Summit County Family Court Records

Family law cases in Summit County — covering divorce and legal separation, child custody, parent-time, child support, domestic violence protective orders, and adoptions — are heard by the 3rd District Court at 6300 Justice Center Road, Suite A, Park City, UT 84098. Records from these proceedings are maintained by the district court clerk.

Divorce Records: Divorce decrees and related case records are filed with the district court. Requests may be made in person at the courthouse during business hours or through the Xchange online portal with a paid account. When making a request, provide the full names of both parties and the approximate year of filing if the case number is not known. The district court may charge fees for copying or certifying records.

Marriage Records: Marriage licenses in Summit County are issued and maintained by the Summit County Clerk’s Office, not the district court. The Clerk’s Office holds marriage records dating back to 1888.

Marriages may also be performed at the Clerk’s Office during regular business hours. Requests for copies should include the names of both parties and the approximate date of the license. Fees apply; contact the office directly for the current fee schedule.

Birth and Death Certificates: Vital records connected to family law matters — such as birth certificates needed for custody proceedings — are maintained by the Summit County Health Department, not the courts. The Health Department processes birth and death certificate requests at three locations:

Certificates can only be processed before 4:30 p.m., Monday through Thursday. Birth certificate fees are $22.00 for the first copy and $10.00 for each additional copy ordered at the same time. Death certificate fees are $30.00 per copy. Online orders can be placed through the Utah vital records online application. Valid government-issued photo identification is required for all requests, and immediate family members must prove their relationship to the record subject. Historical birth certificates for births occurring before the 100-year public record threshold are available through the Utah State Archives.

Summit County Probate Court Records

Probate matters in Summit County — including estate administration, will probate, conservatorships, trusts, guardianships, and name changes — fall under the jurisdiction of the 3rd District Court. The district court clerk at 6300 Justice Center Road, Suite A, Park City, UT 84098 maintains all probate case filings.

How to Request Probate Records:

  1. In Person: Visit the district court clerk’s office at 6300 Justice Center Road during regular business hours (Monday–Friday, 8:00 a.m. – 5:00 p.m.). Provide the decedent’s full name, case number if known, and the approximate year the case was filed to facilitate the search.
  2. By Phone: Call (435) 615-4300 to inquire about available records and any applicable fees before visiting.
  3. Online: Search probate cases through Xchange using the decedent’s name or case number. All public district court documents filed electronically since July 1, 2010 are accessible through the portal with a paid account.

Probate records that are publicly available include petitions for probate, letters testamentary, inventories, accountings, and orders of distribution. Certain filings — such as those involving minors or sealed by court order — may not be publicly accessible. Death certificates needed for probate proceedings can be obtained from the Summit County Health Department as described in the Family Court Records section above. For older historical records, the Utah State Archives is the appropriate repository.
