It is important to understand what Xchange does not display. Sealed cases — including adoptions and civil commitments — are excluded. Expunged records do not appear. Juvenile delinquency, child welfare, and termination of parental rights cases fall under juvenile court jurisdiction and are not searchable through this portal.

GRAMA Records Requests

For records not accessible through Xchange, individuals may submit a written request under the Utah Government Records Access and Management Act (GRAMA). Under Utah Code § 63G-2-204, a written request must include the requester’s name, mailing address, and a clear description of the record sought. Are Court Records Public in Iron County?

Utah law establishes a default presumption of public access to government records. The Utah Government Records Access and Management Act (GRAMA) at Title 63G, Chapter 2 mandates that records created or maintained by governmental entities — including courts — are generally open for public inspection. Under Utah Code § 63G-2-201, any person has the right to inspect a public record free of charge and to obtain a copy upon payment of applicable fees.

However, access to certain Iron County court records is restricted. Categories of records that are either private, protected, or controlled include:

Iron County Criminal Court Records

The 5th District Court handles all felony and Class A misdemeanor criminal cases in Iron County. Class B and C misdemeanors, infractions, and most traffic violations fall under the jurisdiction of the Iron County Justice Court. Justice Court record request fees are as follows:

Private or protected records are released only to the subject of the record as defined under Utah Code § 63G-2-202. Requesters should be prepared to submit a copy of a government-issued ID when requesting protected records.

Criminal Background Checks — Utah BCI

Court records on Xchange are not equivalent to a comprehensive criminal background check. Employers and licensing agencies seeking a formal criminal history report should contact the Utah Bureau of Criminal Identification (BCI), which maintains the statewide criminal history database. BCI background check fees, effective July 1, 2025, are $20.00 for a name/date-of-birth search. Individuals wishing to obtain their own criminal history record from the BCI pay $20.00 and must appear in person at BCI headquarters or submit a notarized application by mail.

Expungement

Eligible individuals may petition the 5th District Court to expunge qualifying criminal records. The filing fee for an expungement petition in district court is $150.00, and $135.00 in justice court, per Utah Code § 78A-2-301, Subsection (1)(i)(i). Expunged records are not visible on Xchange.

Iron County Civil Court Records

Civil matters in Iron County are divided between two courts based on the dollar amount in controversy. The Iron County Justice Court handles small claims cases, while larger civil disputes are resolved in the 5th District Court. Civil court records generally include complaints, answers, motions, orders, judgments, and enforcement documents such as writs of garnishment and execution.

Small Claims Cases

As of 2009, all small claims cases in Utah are filed in the justice court. The Iron County Justice Court at 82 North 100 East, Suite 101, Cedar City handles small claims matters. Small claims filing fees are structured as follows:

Iron County Family Court Records

Family law matters in Iron County are adjudicated at the 5th District Court in Cedar City, which handles divorce and legal separation, child custody, child support, paternity, protective orders, adoptions, and related proceedings. The 5th District Juvenile Court separately handles termination of parental rights and child welfare cases.

Basic divorce record information is generally public. However, under Code of Judicial Administration Rule 4-202.02 (effective April 1, 2012), detailed documents within divorce, custody, guardianship, and paternity case files that contain sensitive personal and financial information may be designated private. The case history, minute entries from public hearings, and final orders and decrees remain public unless sealed by judicial order.

Domestic Violence and Protective Orders

Victims of domestic violence or stalking may petition the 5th District Court for a protective order. These proceedings are handled on an expedited basis, and courts are required to hold a hearing promptly after a petition is filed. Records in these cases may be partially restricted to protect the safety of victims.

Marriage Records

Marriage records in Iron County are maintained by both the county clerk and the Utah Department of Health. Only the subjects of a marriage record and their immediate family members may obtain certified copies. General requests for marriage record information may be directed to the Iron County Clerk’s Office as well.

Birth and Death Records

Birth certificates in Iron County are confidential for 100 years from the date of birth. Access is limited to the record subject, immediate family members, and authorized legal representatives. Death records are restricted for 50 years after the date of death. Certified copies of records within these confidentiality windows must be ordered through the Utah Department of Health Vital Records Office. Records outside these windows are accessible through the Utah State Archives.

Juvenile Court

The 5th District Juvenile Court handles cases involving minors and is located at the same Cedar City courthouse address. Iron County Probate Court Records

Probate proceedings in Iron County are handled by the 5th District Court in Cedar City. The court exercises jurisdiction over the formal and informal administration of decedents’ estates, will contests, intestate succession, guardianships of incapacitated adults, conservatorships, and trust administration matters. The 5th District Court has maintained probate records for Iron County dating back to the late nineteenth century, with formal case files from 1895 onward held at the Utah State Archives for historical matters.

The first paper filing fee for probate and guardianship matters at the 5th District Court follows the same general civil complaint schedule, with the applicable amount determined by the scope of the proceeding. A guardianship of an adult disabled child carries a reduced first-paper fee of $35.00.

Searching Probate Records

Active probate case records are searchable through Xchange by entering the decedent’s name or the case number. Letters of appointment and orders in guardianship and conservatorship cases remain public records unless specifically sealed by the court. Physical case files can be reviewed in person at the Cedar City District Court clerk’s window during regular business hours.
